SECTION 1: INSURING AGREEMENT

In consideration of the payment of the premium and subject to the terms of this policy, the Insurer agrees to indemnify the Policyholder against direct loss or damage by fire or lightning, occurring during the term of this policy to the property described herein.


SECTION 2: COVERED PERILS

This policy covers direct physical loss or damage caused by:

  1. Fire (including resulting smoke, heat, and water damage from extinguishing efforts)

  2. Lightning

  3. Explosions resulting from fire

  4. Removal of property to prevent further damage (for up to [30] days)


SECTION 3: EXCLUSIONS

This policy does not cover:

  1. Loss due to war, nuclear hazards, or terrorism

  2. Intentional acts of the policyholder (arson)

  3. Negligence, lack of maintenance, or inherent defects

  4. Electrical failures unless fire ensues

  5. Theft, vandalism, or civil commotion (unless specifically endorsed)

  6. Floods, earthquakes, or landslides (separate coverage required)

  7. Mold, rot, or gradual wear and tear


SECTION 4: CONDITIONS & DUTIES

A. Policyholder’s Duties in Case of Loss

  1. Notify the insurer immediately upon discovering the loss.

  2. Take reasonable steps to protect the property from further damage.

  3. Submit a Proof of Loss statement within [60] days.

  4. Allow the insurer to inspect the property and review records related to the claim.

B. Insurer’s Responsibilities

  1. Process claims in good faith and complete the loss investigation within [X] days.

  2. Issue payment within [30] days after agreeing to a covered loss.


SECTION 5: LOSS SETTLEMENT PROVISIONS

  • Losses will be settled at Replacement Cost or Actual Cash Value (ACV) based on policy terms.

  • If the policyholder fails to maintain the insured amount at 80% or higher of replacement value, a coinsurance penalty may apply.


SECTION 6: CANCELLATION & NON-RENEWAL

  • By Insurer: The insurer may cancel the policy with [30] days' notice for non-payment or material misrepresentation.

  • By Policyholder: The policyholder may cancel at any time with written notice.
